Delivery and Return Terms

1. Scope

These Delivery and Return Terms apply to every service ordered from DIGITRRIX YAZILIM TEKNOLOJİ HİZMETLERİ VE TİCARET LİMİTED ŞİRKETİ (“Digitrrix”, “we”, “us”) through https://digitrrix.com or under a proposal, statement of work, or project agreement accepted by you. They form an integral part of our Distance Sales Agreement. Where an individually signed project agreement contains a provision that conflicts with these terms, the project agreement prevails.

2. Nature of Our Services

Digitrrix provides project-based digital services: software development, AI solutions, design and branding, digital marketing, media production, and e-commerce solutions. All of our deliverables are services and digital content. We do not ship physical goods, and no cargo or courier process is involved in any order.

3. Delivery Method

Deliverables are handed over electronically. Depending on the project, delivery takes place through one or more of the following:

  • transfer of files, source code, or design assets to a repository, cloud drive, or email address you designate;
  • deployment of the work to a server, domain, app store, or advertising account you own or control;
  • provision of credentials, licences, or access rights to a system or account we have set up for you;
  • performance of the agreed work over a defined service period, for recurring or retainer-based services.

4. Delivery Timeframe

The delivery date, milestones, and project phases are set out in the proposal or project agreement you approve. Unless a different period is agreed in writing, delivery is completed within a maximum of thirty (30) days from the date the order is confirmed and payment is received. For projects that are structured in phases, each phase is delivered on the date stated for that phase.

This period does not run while we are waiting on something only you can supply — content, brand assets, approvals, feedback, or access to your systems. Delays caused by missing input from your side extend the delivery date by the length of the delay, and we will tell you when this happens.

5. Acceptance of Delivery

Once a deliverable is made available to you, please review it and let us know of any discrepancy against the agreed scope within seven (7) days. If we receive no written notice within that period, or if you start using the deliverable in production, the delivery is deemed accepted. Reporting a discrepancy in time does not cost you anything: we correct work that does not match the agreed scope free of charge.

6. If We Cannot Deliver

If the service becomes impossible to perform, we will notify you in writing within three (3) days of learning this, and refund every payment you have made for the undelivered portion within fourteen (14) days of that notice. Where we are unable to meet the agreed delivery date, you may either grant us additional time or cancel the order and receive a refund of the amounts paid for work not yet performed.

7. Right of Withdrawal

If you are a consumer within the meaning of Turkish Consumer Protection Law No. 6502, you may withdraw from the contract within fourteen (14) days of the date the contract is concluded, without giving any reason and without paying any penalty. To exercise this right, send a clear statement to [email protected] within that period. We will confirm receipt of your notice without delay.

8. When the Right of Withdrawal Does Not Apply

Under the Regulation on Distance Contracts, the right of withdrawal cannot be exercised for:

  • services that have been fully performed with your express prior consent and your acknowledgement that you will lose the right of withdrawal upon completion;
  • goods or services prepared to your specifications or clearly personalised — which covers custom software, bespoke design work, and other work produced specifically for you;
  • digital content supplied electronically, and the provision of services, once performance has begun with your approval;
  • services relating to accommodation, transport, car rental, catering, or leisure activities performed on a specific date or period.

Where you ask us to begin work before the withdrawal period expires and you then withdraw, you remain liable for the proportionate value of the work performed up to the moment we receive your withdrawal notice.

9. Cancelling an Ongoing Project

Outside the withdrawal period, either party may terminate a project with written notice. On termination you are responsible for payment of all work completed and all third-party costs committed up to the termination date; any balance you have paid beyond that amount is refunded to you. Deposits that cover work already started or capacity reserved for your project are offset against that amount rather than returned automatically.

10. Correction Instead of Return

Because our deliverables are services rather than physical goods, there is nothing to send back to us. Where a deliverable does not conform to the agreed scope, your remedies are, in order: free correction of the work within a reasonable period, a proportionate price reduction, or — if the non-conformity cannot be remedied — termination of the relevant part of the contract and a refund of the amount paid for it. Requests for changes that go beyond the agreed scope are handled as new work and quoted separately.

11. Non-Refundable Amounts

The following are not refundable once incurred:

  • third-party costs we have paid on your behalf — advertising spend, domain names, hosting, licences, stock assets, app store fees;
  • work already performed and accepted, or work performed during a completed service period;
  • services fully performed at your express request before the end of the withdrawal period.

12. How Refunds Are Processed

Approved refunds are returned within fourteen (14) days to the same payment method used for the original payment. We do not charge any fee for processing a refund. For card payments, the amount is returned to the issuing bank within this period; how quickly it then appears on your statement is determined by your bank and is outside our control.

13. Complaints and Disputes

Please send complaints to [email protected]; we respond within three (3) business days. If a consumer dispute cannot be resolved between us, you may apply to the District or Provincial Consumer Arbitration Committee or the Consumer Court at your place of residence or at the place where the transaction took place, within the monetary limits announced each year by the Turkish Ministry of Trade.
